Getting Ownership/Title for a Motorcycle

    In order of importance :...SPECIAL NOTE > Never say it was built from parts  ...

    1> Affidavit  Saying :

    • I bought a 1948 James motorcycle  (serial number, etc.)
    • From   [ if  known ... ]
    • For   $$$$  [ NOTE  *  Don.t make it too cheap or MTO may ask for appraisal ] 
    • Previous paperwork is lost 
    • I've  done a search for any previous owner &  MTO search  &  NO record was found 
    • I am now the legal &  rightful owner of this  motorcycle ...

    *** The above should be good enough to get an ownership  , [unfit ] ***

    2>  IF you want it on the road > you need a SAFETY  certificate   from any licensed garage ...

    3>  A bill of SALE  for the JAMES ...

    It should NOT mention parts or  basket case ...It can say AS IS .

    *** IF MTO  (or more likely Service Ontario) gives you a hard time, try another office .

    *** Many  times   #1  was good enough for me ...

    My Paralegal friend says he can stamp them. It will help get the affidavit through easer.

    Just went through getting an ownership for a 1971 Yamaha.  Easy with the needed information.  Check with your Service Canada  if they have a "Commissioner" on site.  This person can help you with an affidavit.  Just my 2 cents worth.

    Does this apply to bikes purchased in the U.S. that have no "title" and brought back to Canada?  

    And, can one get a bike over the border if it doesn't have a title or ownership documents?

     Ive Been through this process a few time,s each with luck  and given the understanding the least paperwork you confront any government office the better for their minds to understand  leading to confusion . 

     However I Would Like to Buy a 30,s bike from Alberta , It was Bought over from UK Few Years ago  , the present owner has,nt yet registered a title but has the Landed Certificate from Customs all Legal etc duty paid I guess ? 

    Question === Has any one here have experience of " importing " from another Province  and getting a title  ? It does need some work  , but here the " Restoration " Remark needs To be  Stressed  NOT REBUIDING  or you will have problem with Branding and not having the Manufacturer,s name on Ownership but  RBT !

    Went through this with my Triumph with no ownership and not in MOT puters. Took it to a dealer, St Onge in Barrie. They took the vin put it on their letterhead. Too that to the MOT with the bill of sale. Did the swear thing and walked out with a ownership. But it depends what MOT office you go to. Our local one is useless for anything but basic stuff. I go to the one in Midland after asking the guys where to go. So ask your local guys what' the best one to use.

    Today I went to the Service Ontario office in Millbrook, Ont. Experienced, incredibly helpful and PLEASANT staff walked me right through the process described here. Had a form for me to fill out, notiary on site ($10 cash, thank you very much!) and I was out in 15 minutes! 

    In response to the “out of Country or Province Bikes” question from Mike White: The motorcycle I was successful with today (even with a 4-digest VIN#) was never sold in Canada. At one point (not me) it came to Ontario, probably from Penn., USA. No one asked, and I never brought it up........ John D.

    Hi all, I have just spent two days at the Sarnia Service Ontario, spent $282 on an affidavit as the seller included an ownership that had not been updated to show that the 1975 motor (which serial number had been used for the VIN) had been replaced with a 1972 motor for some reason.  The girl at the counter said "We don't accept affidavits" and she never even looked at it.

    She called their head office and I was told to get the local CVMG's secretary to write up a reason for the VIN number on the US title not matching any number on the motorcycle. But as I am the secretary which I told her I was told I couldn't do that (conflict of interest) so I need my local president to do this, no problem except they want this on a CVMG letterhead which I cannot find. Does anyone have a letterhead for the CVMG? if so could you email to bruff1@sympatico.ca

    You are over doing it / over thinking it ...You are making it hard on yourself ...Read John DeMaria's reply above ... THEN  ? 

    1> Go to another SERVICE ONTARIO ...You may even find one with a NOTARY on site ...Then you're affidavit will cost you nothing ....

    2>  The affidavit is still accepted in Toronto &  many other areas ....It is a legal document , which is stronger than any SERVICE ONTARIO document ...

    3> The affidavit should say    ::::  

      - I bought this bike from   [ name  & address  ] ....Bearing VIN [ the actual  numbers on the frame or  motor  ] ...

    - The full price  paid  was $$$..

    > Previous paperwork for this bike is missing/lost ...

    - I did a search for previous owner &  at  SERVICE ONTARIO  ...NO history was found ...

    - I am now the legal & rightful owner of this bike ... 

    ***  That's  it > NO MORE INFO > you will only confuse the matter ...

    ***Now go find another SERVICE ONTARIO office ..Do NOT go back to the same one because they are stuck in the old mindset ...Whereas another office knows nothing about your situation   !!!

    **** The TITLE you showed , in reality did not apply to the bike [ it is obviously for another bike , which may still be out there somewhere ]  & should never have been shown ....You only needed a RECEIPT   from the seller with the correct numbers on it ...You should have followed the example at the beginning  of this blog & kept it simple ...You over did it & created your own problems & expenses ....

    *** Your experience , when read by a novice , may scare them out of trying to get an OWNERSHIP / TITLE ....

    *** HOPEFULLY  , NOVICES & OTHERS  read this   !!! 

    ****  KEEP IT  SIMPLE  ***
